12:05 p.m.  Review and discuss the KBI Memo regarding THC-infused beverages and its relationship to the hemp derived THC infused beverages exception.

The KBI memo references THC-infused beverages and does not reference the statute that exempts hemp derived products.

One can interpret the statute referenced in the memo and the hemp exception statute as possibly conflicting.

Kansas Beer Wholesalers have established product agreements with suppliers that are designed to assure that their products comply with the legal exemption language in the statute.

The complicating factor is that there is no legal agreement that would provide legal representation or defense to the retailer. So - the retailer may be well within the law to sell the products, but would have to spend the money to defend themselves if charged. 

There are other complicating factors for retailers to consider when selling hemp derived beverages. We hope to discuss them in this online meeting.

At this time, it does not appear the Legislature is interested in amending the statutes to provide clarification.

Meanwhile, Congress had appeared to be on a rapid path to eliminate the hemp exception at the federal level. That was interrupted in the Senate. It may come up again when the budget bill goes to conference committee.
